Technological innovations are being harnessed to enhance efficiency, reduce costs, and streamline processes, thereby fostering a more inclusive legal environment.
Overview of the legal landscape in Nigeria and the impact of technology
A complex interplay of formal laws, traditional practices, and emerging technological advancements characterizes the legal landscape in Nigeria. While the Nigerian Constitution establishes a framework for legal operations, challenges such as corruption, inadequate infrastructure, and limited access to justice hinder effective implementation. However, technology is increasingly reshaping this landscape by enhancing access to legal resources and streamlining judicial processes. For instance, digital platforms facilitate greater connectivity among legal practitioners, enabling the sharing of critical information and resources. Moreover, the integration of electronic filing systems and online dispute resolution frameworks significantly reduces transaction costs and time delays, promoting efficiency in legal proceedings. As these technological innovations take root, they foster a more transparent legal environment and elevate the overall efficacy of law practice in Nigeria, ultimately contributing to a more equitable society. ANALYSIS OF THE NEW SUPREME COURT RULES 2024
The Supreme Court 2024 rules bring significant changes, particularly in embracing technology to enhance the administration of justice. This technological shift is expected to expedite the justice process at the apex level—the major amendments anchored towards Technological Integration.
Here are the following ways the Supreme Court rules include technological innovations in its new provisions:
Duty of the Chief Registrar: Order 2 Rule 1 and 2 of the Supreme Court Rules 2024 adds a blend to the powers of the Chief Registrar that the Chief Registrar will be empowered to do any other lawful duty as directed by the Chief Justice of Nigeria. Also, the Chief Registrar will be the custodian of the physical and electronic records of the Court.
Hour of Opening of Registry: Order 2 Rule 16-18 of the Supreme Court Rules 1985 provides that the hour of the opening of the registry be slated from 8 am to 1 pm, however, the new rules (Order 2 Rule 9) made a significant amendment by extending the time to 4 pm. Inclusively, the new rules further provide for a daily opening of the registry even on weekends and public holidays for electronic filing of processes. This is a significant amendment as it will aid access unhindered access to the Court registry even on weekends or public holidays.
Notification of Sitting: Order 18 of the repealed Rules stated that notification of sitting is to be communicated by means approved by the Chief Justice of Nigeria and via advertisement in the Federal Gazette. However, Order 11 of the new Rules amends that notification can be communicated to the physical or electronic addresses of the parties.
Electronic Seal: Order 2 Rule 4 of the new Supreme Court rules provides for an electronic seal on processes filed electronically as opposed to the repealed rules that failed to provide for this technological innovation.
Files of Document: The new Supreme Court Rules have taken a major leap into the digital age by establishing the Electronic Unit of the Registry. In this provision, the Chief Registrar is mandated to furnish copies of the processes filed in an appeal or in a suit within fifteen days (15 Days) to enable the electronic unit to prepare an electronic file which files and documents relating to the appeal shall be uploaded and stored for access by the Justices of the Court.
Publication of Cause List: Order 2 Rule 10 of the Supreme Court Rules 2024 provides newly that the Registrar shall publish a weekly cause list every Friday on the official Notice Board and website of the Court to set out arrangements for matters to be heard in the subsequent weeks. This is a technological innovation absent from the repealed Supreme Court Rules.
Virtual Hearing: Another key innovation of the New Rules is the introduction of provisions for virtual hearings. In what is almost the exact replication of the CA Rules’ provisions on virtual hearings, the New Rules authorize the Supreme Court to conduct proceedings virtually where it deems fit and make provisions for notification, dress code, etiquette, and other matters related to virtual hearings.
